Terms of Service

These Terms govern your use of the VAELIX mobile game (the “Game”) and its related services. By downloading or playing the Game you agree to them. If you do not agree, do not use the Game.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download and play the Game for your own non-commercial entertainment. All rights in the Game — including its software, art, characters, music and trademarks — belong to us or our licensors. You may not copy, modify, reverse engineer, resell or exploit the Game except as allowed by law.

3. Your account

• When you first play, a guest account is created on your device. A guest account can be lost if you uninstall the Game or change device; link an email or Google account in Profile → Account to keep your progress.
• You are responsible for keeping your login details secure. One account per person; accounts may not be sold, shared or transferred.
• Players under 14 need the consent of a parent or guardian.
• You can delete your account at any time (Profile → Account → Delete account, or see this page). Deletion is permanent.

4. Usernames and conduct

Choose a username that is not offensive, hateful, sexual, misleading or infringing anyone's rights, and does not impersonate others. We may change unsuitable usernames. When you play you must not:

• cheat, use bots, exploits, modified clients or third-party tools that give an unfair advantage;
• intentionally lose matches, manipulate matchmaking or leaderboards, or share accounts to do so;
• attack, overload or try to access our servers or other players' data;
• harass other players or break the law.

We may suspend or terminate accounts and reset progress obtained by breaking these rules. We will act proportionately and, where reasonable, tell you why.

5. Virtual items and currencies

• Coins, Gems, heroes, variants, cosmetics, season passes and other virtual items (“Virtual Items”) are a licence to use content inside the Game. They have no monetary value, cannot be exchanged for real money or transferred outside the Game, and are not your property.
• Virtual Items can be earned by playing or purchased. Prices are shown in the store before you confirm.
• Game balance, rewards and the content of Virtual Items may change as the Game is updated.

6. Purchases

• Purchases are processed by the App Store or Google Play and are also subject to their terms. Refund requests for payments are handled by them under their policies.
• Purchased Virtual Items are delivered immediately. By completing a purchase you expressly request immediate delivery and acknowledge that you lose the 14-day right of withdrawal once delivery has begun (art. 59(1)(o) of the Italian Consumer Code and Directive 2011/83/EU). This does not affect your statutory rights if an item is not delivered or does not work.
• Virtual Items are not refunded when you delete your account or when an account is terminated for breaking these Terms, except where required by law.

7. Availability and changes

The Game is provided as a live online service. We may update, change or temporarily interrupt it for maintenance or improvements. Online features need an internet connection. We may end the Game; if so we will give reasonable advance notice in the Game, and where required by law we will offer an appropriate remedy for unused paid Virtual Items.

8. Liability

We provide the Game with reasonable care. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for wilful misconduct or gross negligence, or your rights as a consumer. Within those limits, we are not responsible for losses caused by events outside our reasonable control, by your device or internet connection, or by your breach of these Terms.

How we use your data is described in the Privacy Policy.

10. Changes to these Terms

We may update these Terms, for example to reflect new features or legal requirements. We will notify you of material changes in the Game. If you keep playing after they take effect, the new Terms apply; if you do not agree you can stop playing and delete your account.

11. Law and disputes

These Terms are governed by Italian law. Disputes are subject to the courts of Turin, Italy, without prejudice to the mandatory rights of consumers, who may also bring proceedings before the courts of their place of residence in the European Union. EU consumers can also use the European Commission's Online Dispute Resolution platform.
